1. Who Can Use the Services

You must be at least 13 years old to use the Services. If you are between 13 and the age of legal majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to be responsible for your use.

You may use the Services only if you can form a binding contract and your use is not prohibited by law. The Services are intended for users located in the United States.

2. Accounts

You must create an account to use the Services, and you agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for keeping your login credentials confidential, for all activity under your account, and for notifying us promptly at legal@huntingclub.app if you believe your account has been accessed without authorization.

You may not create an account for someone else without permission, share your account, sell or transfer your account, or create multiple accounts to evade restrictions or enforcement.

3. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share information. Please read it carefully.

4. Clubs and Member-Organized Activity

Clubs are created and managed by their owners and administrators. Membership, roles, invitations, events, stands, dues, and fines are administered by each club's own organizers.

Any dues or fines tracked in the Services are an organizational convenience between members and their club. Unless a payment is processed through our payment provider, we do not collect, hold, transfer, or guarantee those funds, and we are not a party to financial arrangements between members and their clubs.

You are solely responsible for complying with all laws that apply to your hunting activity, including licensing, tags, seasons, bag limits, land access, firearm laws, and reporting requirements.

5. Acceptable Use

You agree to use the Services only for lawful purposes and in a way that does not violate the rights of others or interfere with the operation of the Services. You may not:

• violate any law, regulation, or third-party right, including hunting, firearms, wildlife, and land-use laws;
• use the Services for fraud, harassment, threats, stalking, abuse, or impersonation, or to misrepresent your affiliation with a club or organization;
• post or transmit defamatory, obscene, hateful, sexually explicit, or otherwise objectionable material;
• post content that infringes another person's intellectual property, privacy, publicity, or other rights, or upload media you do not have the right to share;
• upload malware or harmful code, or interfere with or disrupt the Services, servers, or networks;
• scrape, crawl, copy, or harvest data from the Services without our written permission;
• reverse engineer, decompile, or attempt to extract source code except where prohibited by law;
• use bots, scripts, or automation to access or misuse the Services;
• advertise, spam, or solicit unrelated commercial activity without our permission;
• attempt to bypass security features or access controls; or
• submit false reports, false safety information, or misleading location or club data.

We may investigate suspected violations and take any action we believe is appropriate.

6. User Content

The Services let you create, upload, post, store, or share content, including text, photos, videos, harvest records, club information, profile information, comments, and other materials ("User Content"). You are solely responsible for your User Content and the consequences of sharing it.

You represent and warrant that you own your User Content or have all rights needed to submit it and grant the license below, that it does not violate the law or any third-party right, and that it is not materially misleading.

7. License You Grant Us for User Content

You keep ownership of the User Content you submit. By submitting or sharing User Content, you grant Hunting Club LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, display, distribute, and otherwise use that User Content as needed to operate, provide, secure, support, and improve the Services (for example, showing your posts to your club or, where you choose to post publicly, to the broader Hunting Club community) to moderate content, create backups, enforce these Terms, and develop new features.

8. Content Moderation and Reporting

We may, but are not required to, review, monitor, remove, restrict, or refuse User Content at any time, including content we believe violates these Terms, the law, or our community or safety standards.

You can report content or users you believe violate these Terms using the in-app reporting tools. Reports are reviewed by our team; we may act on them at our discretion and are not obligated to take any particular action.

9. Safety; Check-ins Are Not an Emergency Service

Features such as stand check-in and the active-hunter "safety board" are conveniences to help clubs stay aware of who is afield. They are NOT a safety, emergency, or location-tracking service, may be delayed, inaccurate, or unavailable, and are not a substitute for safe hunting practices, communication plans, or contacting emergency services. You use these features at your own risk.

The Services are provided for general informational and organizational purposes only. We do not provide legal, safety, hunting, firearm, land-access, or other professional advice.

10. Intellectual Property

The Services (including the app, software, design, text, graphics, logos, icons, images, features, and functionality) are owned by Hunting Club LLC or its licensors and are protected by copyright, trademark, trade secret, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services as permitted by these Terms.

11. Feedback

If you give us suggestions, ideas, or feedback about the Services, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use it for any purpose without compensation or obligation to you.

12. Premium, Subscriptions, and Billing

Hunting Club Premium is an optional paid subscription offered with monthly and annual billing options. The price, billing period, and any applicable taxes shown to you at the time of purchase control — in the app store for in-app purchases, or at checkout for purchases made on the Hunting Club website.

Premium is offered as an auto-renewing in-app purchase through the Apple App Store and Google Play (managed with the help of RevenueCat), charged to the payment method on file with that store. Premium may also be purchased on the Hunting Club website; website purchases are processed by our payment provider and charged to the payment method you provide at checkout.

Subscriptions renew automatically for the same period unless you cancel before the renewal date. App Store and Google Play subscriptions are charged for renewal within 24 hours before the end of the current period unless auto-renew is turned off at least 24 hours before the period ends; manage or cancel them in your App Store or Google Play account settings. Website subscriptions can be managed or canceled through the billing portal linked from your account.

13. Cancellations and Refunds

You may cancel at any time through the store or billing portal where you purchased. Unless required by law or applicable app-store policy, all purchases are final, fees are non-refundable, and we do not provide refunds or credits for partial periods or unused time.

14. Apple App Store: Additional Terms

If you downloaded the app from the Apple App Store, the following also apply: these Terms are between you and Hunting Club LLC only, not Apple, and Apple is not responsible for the app or its content. Your license to use the app is a non-transferable license to use it on Apple-branded devices you own or control, as permitted by the App Store Usage Rules.

Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for any product warranties, for addressing any claims relating to the app (including product-liability, legal/regulatory, or consumer-protection claims), or for handling intellectual-property claims regarding the app. You represent that you are not located in a U.S.-embargoed country and are not on a U.S. prohibited-party list, and you will comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Google Play: Additional Terms

If you downloaded the app from Google Play, your use is also subject to the Google Play Terms of Service, and in-app purchases are billed through Google Play. These Terms are between you and Hunting Club LLC, not Google.

16. Third-Party Services

The Services rely on third-party providers, including Supabase (authentication, database, and file storage), Resend (email delivery), Expo (push notifications and anonymous usage diagnostics), Vercel (hosting), RevenueCat (mobile in-app purchases), the Apple App Store and Google Play (mobile app distribution and billing), and our website payment provider for web subscription checkout.

We do not control these services and are not responsible for their availability, content, policies, or actions. Your use of them may be subject to their own terms and privacy policies.

17. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUNTING CLUB LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 USD.

19. Indemnification

You agree to defend, indemnify, and hold harmless Hunting Club LLC and its officers, members, and agents from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, your violation of these Terms or of any law or third-party right, or your misuse of the Services.

20. Suspension and Termination

We may suspend, restrict, disable, or terminate your access or account at any time, with or without notice, for violations, abuse, legal requirements, or security reasons. You may stop using the Services and delete your account at any time from your settings.

21. Governing Law

These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-laws rules.

22. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Alabama, and you consent to their jurisdiction and venue.

23. Changes to the Services

We may update, modify, suspend, or discontinue all or part of the Services at any time, including features, content, availability, and pricing, to the extent permitted by law. We are not liable if any part of the Services is unavailable at any time.

24. Changes to These Terms

We may update these Terms from time to time. The updated Terms take effect on the "Last updated" date above unless stated otherwise, and where appropriate we will notify you in the app. Your continued use of the Services after changes take effect means you accept the revised Terms.

25. Electronic Communications

By creating an account or using the Services, you agree to receive electronic communications from us related to the Services, including by email and in-app notifications.

26. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and Hunting Club LLC regarding the Services. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
